This document constitutes a Public Offer in accordance with Article 681 of the Civil Code of the Republic of Moldova and Law No. 284 “On Electronic Commerce.”
This document represents an official offer from CUSTOM CLOTHES LLC (hereinafter referred to as “the Provider”), addressed to an indefinite number of persons, to conclude a paid Service Agreement with the Provider under the conditions set forth below.
By accepting the terms described below, the Client agrees to pay for the Order and its delivery under the conditions provided in this offer.
1.1. For the purpose of this document, the following terms are used with the meanings indicated below:
Offer — this document titled “Offer for the Provision of Services,” published online at https://custom.md/;
Acceptance of the Offer — full and unconditional acceptance of the Offer by making payment for the order. Upon Acceptance, the Contract is deemed concluded;
Contract — a paid agreement between the Client and the Provider for the provision of services, concluded by Acceptance of the Offer;
Client / Buyer — a natural person who has accepted the Offer;
Provider — CUSTOM CLOTHES LLC;
Parties — collectively, the Provider and the Client;
Services — embroidery, logo application, and production of customized or sample-based products, as presented on https://custom.md/;
Order — a request for embroidery or production services, specifying the service type, design (if applicable), description, dimensions, and quantity, made via https://custom.md/;
Website / Online Store — the website available at https://custom.md/.
1.2. Terms not defined in paragraph 1.1 shall be interpreted according to the legislation of the Republic of Moldova and the general meaning of the Offer.
2.1. The Provider undertakes to provide services to the Client, and the Client undertakes to pay for them under the conditions of this Offer.
2.2. The Provider offers embroidery and product manufacturing services based on samples or individual orders received through the website and undertakes to deliver the result, while the Client agrees to accept and pay for it.
2.3. The Provider uses its own materials (fabrics, threads, linings, accessories) unless otherwise agreed with the Client.
2.4. The Client independently selects the type of service, model, color, and quantity of products, and provides measurements according to the size chart available at https://custom.md/sizetable/.
2.5. The Provider is not responsible for the accuracy of data provided by the Client.
2.6. The standard production time for an order is up to 3 business days, provided materials are available. If materials are unavailable, the production time is extended by the duration of delivery, and the Client is notified via phone or email.
2.7. The Provider reserves the right to refuse service if technical or material limitations arise.
2.8. The Client has the right to cancel the order before production begins. If an advance payment was made and the order is canceled before execution, the advance is refunded in full.
2.9. Ownership rights and the risk of accidental loss pass to the Client upon handover of the goods to the Client or to the transport company.
2.10. Place of service provision: Str. Pușkin 66, Comrat, Republic of Moldova.
3.1. Orders can be placed through the website https://custom.md/, by phone (+373) 76088860, or via messaging apps (WhatsApp, Viber).
3.2. The Provider confirms the order within one business day.
3.3. The Client is responsible for the accuracy of all information provided.
3.4. If materials are unavailable, the Provider notifies the Client to agree on replacements or revised delivery terms.
3.5. Product and service descriptions on the website are for informational purposes only. Colors may vary due to screen settings. The Client must contact the Provider for clarification before placing an order.
3.6. The Provider is not responsible for information published outside its official website.
4.1. When placing an order, the Client provides personal data: full name, email, phone number, and delivery address.
4.2. The data are provided voluntarily and used solely for order fulfillment in accordance with Moldovan Law No. 133/2011 on the protection of personal data.
4.3. The Provider undertakes not to disclose Client data to third parties, except for those involved in order fulfillment (delivery, accounting) or in cases required by law.
5.1. Delivery time ranges from 3 days to 2 weeks, depending on the delivery method and region.
5.2. The Provider is not liable for delays caused by courier services or force majeure circumstances.
5.3. Delivery is carried out via courier, Moldovan Post, or pickup points.
5.4. Delivery cost is determined individually when placing the order.
5.5. Ownership and risk pass to the Client upon transfer of the order to the carrier.
5.6. The Provider’s obligation to deliver is considered fulfilled once the order is handed over to the carrier.
6.1. Payment may be made in full or partially (by agreement) in cash, by bank transfer, or via electronic payment.
6.2. All payments are made in Moldovan lei (MDL).
6.3. Orders must be paid within 3 banking days from issuance. Payment is deemed completed once funds are credited to the Provider’s account.
6.4. Payment by the Client constitutes Acceptance of this Offer.
7.1. Returns are regulated by Law No. 105-XV of March 13, 2003 “On Consumer Protection.” Customized or personalized goods of satisfactory quality cannot be returned.
7.2. In the event of product rejection, refunds are issued within 3 business days after the product is returned, excluding delivery costs.
8.1. Disputes are resolved through negotiations and written claims within 10 days.
8.2. If no agreement is reached, disputes shall be settled by the competent court of the Republic of Moldova.
9.1. Force majeure refers to unforeseeable circumstances that release the Parties from liability for the duration of their effect.
9.2. The affected Party must promptly notify the other Party of the force majeure event.
10.1. The Offer becomes effective upon publication on https://custom.md/ and remains valid until withdrawn by the Provider.
10.2. Amendments become effective upon publication.
11.1. Acceptance of the Offer constitutes the conclusion of the Contract.
11.2. The Contract remains valid until all obligations are fulfilled or it is terminated.
12.1. In all matters not covered by this Offer, the Parties shall be governed by the laws of the Republic of Moldova.
12.2. The Client guarantees full understanding and acceptance of the terms of this Offer.
